1. Acceptance of Terms

By creating an account or using Calypso Intelligence ("Calypso", "the Platform", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not access or use our services.

These Terms constitute a legally binding agreement between you and Team Calypso, governed by the laws of India, including the Information Technology Act, 2000, and all applicable rules and regulations.

2. Prohibited Activities & Cybersecurity

Users shall not abuse the system in any form. Cybersecurity violations are punishable offenses under the Information Technology Act, 2000, and may result in criminal prosecution, civil liability, and immediate account termination.

You are strictly prohibited from:

• •Unauthorized Access: Attempting to access, probe, or test the vulnerability of any system, network, or data without explicit authorization
• •Hacking & Penetration Testing: Using any automated tools, scripts, bots, or manual techniques to gain unauthorized access to the Platform or bypass security measures
• •Injection Attacks: Attempting SQL injection, XSS (Cross-Site Scripting), CSRF, or any other code injection attacks
• •DDoS & Resource Exhaustion: Overloading our servers, initiating denial-of-service attacks, or deliberately consuming excessive computational resources
• •Data Scraping & Harvesting: Using automated means to extract, scrape, or harvest data from the Platform without written permission
• •Reverse Engineering: Decompiling, disassembling, or reverse engineering any part of our software or AI models
• •Credential Sharing: Sharing, selling, or distributing your account credentials or access tokens to third parties
• •Fraudulent Activities: Creating fake accounts, impersonating others, or engaging in payment fraud
• •Malicious Content: Uploading viruses, malware, trojans, ransomware, or any harmful code
• •API Abuse: Exceeding rate limits, making excessive API calls, or using the API in violation of our policies
• •Illegal Content Generation: Using our AI services to generate content that violates Indian laws, including but not limited to defamatory, obscene, or hateful content
• •Intellectual Property Theft: Using the Platform to infringe copyrights, trademarks, or other intellectual property rights

3. Fair Use Policy

Calypso is an educational platform designed to enhance learning. Users must:

• • Use the Platform for legitimate educational purposes only
• • Respect usage quotas and rate limits imposed on your account tier
• • Not resell, redistribute, or commercialize AI-generated content without authorization
• • Maintain the confidentiality of their account and report any unauthorized access immediately
• • Comply with all applicable local, state, national, and international laws

4. Intellectual Property Rights

All intellectual property rights in the Platform, including but not limited to software, AI models, algorithms, design, logos, trademarks, and documentation, are owned by Team Calypso or our licensors. The Calypso name, logo, and all related marks are trademarks of Team Calypso.

AI-generated content created through the Platform is provided "as-is" for your educational use. While you may use such content for personal learning, Team Calypso retains the right to use, analyze, and improve our services based on aggregated usage patterns.

5. Data Protection & Privacy

We are committed to protecting your personal data in accordance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. We collect, process, and store your data including:

• • Account information (name, email, authentication credentials)
• • Usage data (sessions, interactions, learning progress)
• • Technical data (IP addresses, device information, browser type)
• • User-generated content (questions, documents, chat history)

Your data is used solely to provide, maintain, and improve our services. We implement reasonable security measures to protect your data but cannot guarantee absolute security. We do not sell your personal data to third parties.

6. Intermediary Status & User Content

Calypso acts as an intermediary under Section 79 of the Information Technology Act, 2000. We do not initiate the transmission, select the receiver, or modify user-generated content. We are not liable for any third-party content transmitted or stored on our Platform, provided we comply with due diligence requirements.

If you believe any content on our Platform violates your rights or applicable laws, please contact us immediately with detailed information. We will take appropriate action as required by law.

7. Limitation of Liability & Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

• • Uninterrupted or error-free service availability
• • Accuracy, completeness, or reliability of AI-generated content
• • That the Platform will meet your specific requirements
• • That defects will be corrected or security vulnerabilities will be absent

IN NO EVENT SHALL TEAM CALYPSO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS.

8. Contributions and Project Support

Calypso operates on a mission-driven, community-funded model. When you choose to support the project as a "Project Sustainer," your contribution directly funds the high-performance infrastructure (including cloud storage, compute resources, and premium 3rd party AI APIs) required to maintain and expand our cognitive grid.

Contribution Term & No Auto-Renewal

Each project contribution provides "Project Sustainer" access for a fixed duration of **30 days**. Calypso **does not utilize automatic renewals**. Upon the expiration of the 30-day period, your account will automatically return to "Community Member" status unless a new manual contribution is initiated.

Non-Refundable Policy

Because infrastructure costs (Compute, Storage, and API usage) are incurred instantaneously upon your support of the project, all contributions are strictly final and non-refundable. We do not offer pro-rated refunds for any unused portion of the 30-day term.

9. Account Termination

We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

• • Violate any provision of these Terms and Conditions
• • Engage in prohibited activities or cybersecurity violations
• • Provide false or misleading information during registration
• • Abuse our contribution system or infrastructure
• • Engage in conduct that damages our reputation or business

You may terminate your account at any time by contacting our support team. Upon termination, your right to use the Platform ceases immediately, and we may delete your data as per our retention policies.

10. Modification of Terms

Team Calypso reserves the right to modify, amend, or update these Terms and Conditions at any time, at our sole discretion, without prior notice.

When we make changes to these Terms:

• • We will update the "Last Updated" date at the top of this page
• • For material changes, we may notify you via email or through the Platform
• • Your continued use of the Platform after changes constitutes acceptance of the revised Terms
• • If you do not agree to the revised Terms, you must stop using the Platform and terminate your account

It is your responsibility to review these Terms periodically. We recommend checking this page regularly to stay informed of any updates.

11. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.

Before initiating legal proceedings, parties agree to attempt resolution through good-faith negotiation. If negotiation fails within 30 days, either party may pursue formal legal remedies.
